These SMS Terms and Conditions (“SMS Terms”) govern text messages sent by or on behalf of Interkey, Inc. (“Interkey,” “we,” “us,” or “our”).
These SMS Terms supplement our general Terms and Conditions and Privacy Policy. If these SMS Terms conflict with the general Terms and Conditions regarding text-message communications, these SMS Terms will control.
By providing your mobile telephone number and consenting to receive text messages from Interkey, you agree to these SMS Terms.
1. Description of the SMS Program
Interkey may send text messages concerning:
Service inquiries
Intake-quiz submissions
Consultation requests
Appointment scheduling and reminders
Quotes and proposals
Lead-generation services
Advertising and marketing services
Customer financing inquiries
Lead-supplier applications
Account or service updates
Follow-up communications
Customer support
Promotional offers and marketing messages, where consent has been provided
Messages may be sent manually or through automated technology.
2. Consent to Receive Messages
By submitting your mobile telephone number through an Interkey form, intake quiz, chat, application, or other consent mechanism, you authorize Interkey to send text messages to that number for the purposes described in the consent language presented when you submit it.
Your consent applies only to the types of communications described at the time consent is obtained.
Consent to receive marketing text messages is not a condition of purchasing goods or services.
You represent that:
You are at least 18 years old.
You are the subscriber or customary user of the telephone number provided.
You are authorized to consent to messages at that number.
The information you provide is accurate.
Providing a telephone number without agreeing to the applicable consent language does not, by itself, authorize recurring promotional text messages.
3. Types of Messages
Interkey may operate more than one category of text-message communications.
Conversational Messages
These are messages sent in direct response to an inquiry or an ongoing conversation.
Examples include:
Responding to a question
Discussing requested services
Coordinating a consultation
Following up on an application
Providing requested information
Transactional and Informational Messages
These messages relate to a request, appointment, service, application, or existing business relationship.
Examples include:
Intake-form confirmations
Appointment reminders
Application status updates
Account notifications
Service updates
Customer-support messages
Marketing Messages
These messages may promote Interkey services, offers, programs, or related business opportunities.
Marketing messages will be sent only where Interkey has obtained the consent required by applicable law and carrier requirements.
4. Message Frequency
Message frequency varies depending on your interactions with Interkey.
You may receive multiple messages while:
Completing an inquiry
Scheduling a consultation
Discussing services
Receiving appointment reminders
Applying to sell leads
Requesting information about customer financing
Participating in an active marketing program
Promotional message frequency may vary based on the campaign and your engagement.
Interkey does not guarantee any fixed number of messages.
5. Message and Data Rates
Message and data rates may apply according to your mobile carrier and service plan.
Interkey does not charge a separate fee for receiving its text messages, but your carrier may impose charges for:
Text messages
Multimedia messages
Data use
Roaming
Other wireless services
You are responsible for charges imposed by your carrier.
6. How to Opt Out
You may revoke consent and stop receiving text messages at any time by replying:
STOP
We will treat other clear opt-out requests as revocations where required, including commonly recognized terms such as:
CANCEL
END
QUIT
UNSUBSCRIBE
STOPALL
REVOKE
OPTOUT
After you opt out, Interkey may send one final text message confirming that your request was processed. No further messages covered by that consent will be sent unless you later provide new consent.
FCC regulations recognize reasonable methods of revoking consent and permit one non-marketing confirmation message after a valid opt-out request.
Opt-out requests may take a short period to process, but Interkey will honor them as required by applicable law.
7. Scope of an Opt-Out
An opt-out applies to messages associated with the Interkey messaging program and sender through which the request was made.
Because Interkey may use more than one telephone number or messaging program, you should submit an opt-out request to each number from which you no longer wish to receive messages.
Interkey will also use reasonable measures to apply a clear revocation request across related messaging systems when required by law or reasonably identifiable from the request.
Opting out of marketing messages may not prevent Interkey from sending messages that are legally permitted and necessary to:
Respond to a new request you initiate
Provide requested customer support
Complete a transaction
Deliver legally required notices
Confirm an opt-out request
Submitting a new inquiry after opting out does not necessarily restore consent to recurring marketing messages. New consent may be required.
8. Re-Enrolling
After opting out, you may resume text messages by:
Replying START, where supported
Submitting a new form with appropriate consent
Providing new written consent through another approved method
Re-enrollment is effective only after Interkey receives valid new consent.
Twilio’s messaging systems generally support standard keywords such as STOP, START, and HELP, although keyword behavior may depend on the number and messaging configuration being used.

The HELP response may include Interkey’s name, contact details, and instructions for opting out.
10. Sender Identification
Interkey will identify itself in its text-message communications, especially in the first message or when the sender may not otherwise be apparent.
Messages may be sent using telephone numbers or messaging services provided through Twilio or another communications provider.
Twilio requires senders to identify the party that obtained the recipient’s consent and requires a straightforward opt-out process.
11. Automated Technology
Interkey may use automated systems to:
Send text messages
Schedule follow-up
Route responses
Confirm appointments
Provide reminders
Deliver requested information
Manage opt-out requests
Consent to receive messages through automated technology will be obtained where required.
Marketing texts sent using regulated automated technology may require prior express written consent under federal law.
12. Carrier Availability
Text-message services may not be available through every carrier, device, or service plan.
Delivery is subject to:
Wireless-carrier availability
Network conditions
Device compatibility
Number status
Message filtering
Platform availability
Third-party service interruptions
Interkey and wireless carriers are not liable for delayed, blocked, filtered, undelivered, or misdirected messages to the maximum extent permitted by law.
Carriers are not responsible for the content of Interkey’s messages.
13. Supported Carriers
Interkey’s messaging program may be available through most major United States wireless carriers, but carrier participation and support may change without notice.
Availability through a particular carrier is not guaranteed.
14. Telephone Number Changes
You agree to notify Interkey or opt out before discontinuing, transferring, or changing the mobile number you provided.
If you stop using the number without notifying us, messages may be delivered to the number’s new owner.
You agree that you are responsible for maintaining accurate contact information and for requests made using a number under your control.
15. Privacy
Information collected through Interkey’s SMS program may include:
Your mobile telephone number
Consent records
Message content
Message timestamps
Delivery status
Opt-in and opt-out activity
Device and carrier information
Links clicked
Information submitted during a conversation
We use this information to:
Deliver and manage messages
Respond to inquiries
Maintain consent records
Honor opt-out requests
Improve communications
Prevent fraud or abuse
Comply with legal and carrier requirements

16. Twilio and Other Service Providers
Interkey may use Twilio, HighLevel, and other service providers to transmit, receive, route, store, and manage text messages.
These providers may process telephone numbers, message content, delivery data, opt-out status, and related technical information on Interkey’s behalf.
Twilio’s messaging policies require recipient consent, sender identification, and the honoring of opt-out requests.
17. Prohibited Conduct
You may not use Interkey’s messaging channels to:
Send unlawful, threatening, abusive, or harassing content
Impersonate another person
Submit fraudulent information
Transmit malware or harmful code
Interfere with messaging systems
Attempt unauthorized access
Violate another person’s privacy or intellectual-property rights
Use automated systems to abuse or overload the messaging service
Engage in any conduct prohibited by law
Interkey may block or restrict messaging access in response to suspected abuse, fraud, security threats, or unlawful conduct.
18. No Guarantee of Response or Availability
Text messaging is provided as a communication convenience.
Interkey does not guarantee:
Immediate responses
Continuous availability
Successful delivery
Compatibility with every device
That messages will satisfy urgent or emergency needs
Do not use Interkey’s text-message service for emergencies.
19. Changes to the SMS Program
Interkey may modify, suspend, or discontinue all or part of its SMS program at any time.
Changes may include:
Message types
Message frequency
Telephone numbers
Technology providers
Available keywords
Support contact information
Where required, Interkey will provide notice or obtain renewed consent before making a material change to the scope of recurring marketing messages.
20. Changes to These SMS Terms
Interkey may update these SMS Terms periodically.
The updated version will be posted on the Website with a revised “Last Updated” date.
Changes will apply prospectively. Interkey will not rely solely on an update to these terms to materially expand the marketing messages authorized by prior consent where applicable law requires new consent.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SMS PROGRAM IS PROVIDED “AS IS” AND “AS AVAILABLE.”

FREE FROM TECHNICAL ERRORS
Nothing in this section limits rights that cannot legally be waived.
22. Limitation of Liability
To the maximum extent permitted by law, Interkey will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:
Delayed or failed message delivery
Carrier filtering
Unauthorized access to a device
A recycled or reassigned telephone number
Network or platform outages
Reliance on a text message
Your failure to update contact information
Any limitations contained in Interkey’s general Terms and Conditions also apply to the SMS program to the extent legally enforceable.
23. Governing Terms
These SMS Terms are incorporated into Interkey’s general Terms and Conditions.
Matters not specifically addressed here are governed by:

Interkey’s Privacy Policy
Any separate written agreement between you and Interkey
